We discussed this bill the last time in the context of a hit on the General Fund during a time when we have already as a body the corporate income tax has already been drpped in the 2013 legislation and this represents one more loss of revenue at a time when, this channel assembly has set it policy there should be no selection of winners and losers. This industry is a winner. It's the kind of selection that according to 2013 election was not supposed to happen. It is here though and let me make a second point about this bill, that I did not bring up and [xx] did not discuss last time about the bill, and that is this, historically the 1%, 80$ sales tax break was given to manufacturers because they sold the product and sales tax was collected at the end, that is to say, the break was given on how much  sales tax the manufacturer should pay because the manufacturer was charging full sales tax on the sale of the product. What is different about this bill and what it starts to bring

is down a dangerous road, is that we're giving the 1% $80 to a company that is not selling the product, but is simply passing the product along as part of a contract, and it is not, the company is not selling the product. There's a real difference because the company itself is not collecting sales tax, if it's collecting sales tax, the argument can be made that it shouldn't charge them on the frontend for the different products that then go into the bill, but since it's not happening That way now, in this case the metal fabricators are not charging sales tax on what they produce, but in fact they're passing along to the contractor it is dangerous road for us to go down, and I encourage you to vote No on the bill. Recently the entrainer has come along and there are statues needs to be updated because of the dispute, the roles regarding and providing local services on the internet what this bill does is resolves the issues between certain parties as it relates in internet. Anyone can use the internet to provide form anyone can do anything they were doing prior to that lawsuit which includes the realtors and others using their forms but it would stop the the person providing the legal forms from getting legal advice this bill has the support of the entire legal community and I would appreciate your support. This bill is really a qualification of a lawsuit between LegalZoom and state bar, all parties have agreed to this language For what purpose does the gentleman from Wake, Representative Stam rise? Thank you Mr. Speaker I just want to briefly debate the bill and then offer and amendment, to give you a little bit of background on this legislation, the reason for it just so you know, in regards to private or public impacts to federally regulated wetlands, we are all having existing established wetland mitigation banks whether public or private, see you have hudreds to thousands of acres be set aside for this impact of federally regulated wetland what this bill is seeking to do is to actually achieve equal or lower calls to get at those medigation credits while also bringing together wildlife, in terms of wildlife habitats as well as and sportsman opportunities as well as bring dinner to the table to actually see that to actually come forward it also brings some groups together for them to actually invest their monies in effort to these wealthy mitigation banks capitalize for wild life habitat in diversity as well as for earning opportunities. [xx] any questions that you have on the bill but I believe that this is a win, win for wildlife, for dinner, for the tax payer as well as for the honor and its sportsmen. Thank you Mr. Speaker and colleagues, this is a bill that will direct the department of environment and natural resources to work with various others state agencies, expertise, stakeholders to develop a state plan for compliance with federal clean power plan requirements in federal law, if on my side of the aisle, looking at the bill initially some us no doubt will have a bit of a purse going what is this bill about? It's about out requiring us to comply with the Obama administration's new clean power laws and McGrady he wants us to vote for that? Well, sometimes things aren't exactly the way they seem and this perhaps is one of those bills this is really a stake holder bill. It's a bill that's intended to make sure the state does not get caught with it spins down and let me just take you through the bill really quickly. The first section is a lot of definitions. The key active phrase comes down on for page 1 line 27 the department of environment natural resources should develop a state plan for compliance with e-bay [xx] plan. The minute sets forth in great detail all the various things that need to be considered. Now, the list of various things that need to be considered is actually much broader than the list that the E. P. A might put forward, it includes cost issues, stranded assets whole range of business side issues and not just environmental issues section three of the bill after going through at great length the various things that need to Section 3 provides for a certain mineral reports to the general assembly and this is the most important piece for those of you who might have some hesitation with the bill. Now this plan right now is being challenged by I think by about a dozen states that have challenged it before the plan even becomes final. The expectation is that once the plan becomes final which will occur in presumably, then  a number of other states who moved to challenge the plan, and the plan could go away in which case this whole process goes away but if the plan doesn't go away that away there's obviously the political route, there could be another administration that decides differently than this administration has and decides to roll back the rules in which

case this goes away also. I told you that the bill is rather interesting my colleague from right next door in the mountains and I don't always agree on Energy and Environment issues but Representative Hager and I are both co-sponsors of this bill because we think it's a good planning bill, we don't want to get caught after the litigation goes on and nothing has happened and we just left it up to Dina to figure it out. This requires Dina to work with a range of stakeholders on process and then the other thing to understand about the bill is that, this is a bill that you can actually support that the elective cooperative support to my knowledge all of the distance community supports and all the environmental community supports. Everybody agrees that we need to bring everybody to the table and talk about these issues as opposed to getting in 26 teams or whenever and suddenly finding themselves in a position where we just left it to the department to put forward the plan without the input of all this significant players. So I ask for your support to for this bill I'm not aware of any awkward opposition to it as you might imagine to the department of environment and natural resources isn't widely enthusiastic about the bill, primarily because they think they can do the job. Does the gentleman from Henderson Yield to a second question? yes Representative Mcgrady, in your recent response as well as you presentation you keep referring to this rule 111D as the current law, my question to you is how is a rule that was promulgated by Executive Feur [sp] that is gained to be litigated, can be considered as law The rule is in it's address stage in this point in time, it is not yet is not anticipated to go final till this summer, current schedule would side guess it would go final in the summer and there after, I suspect will not be final until the last litigation is complete. Mr. Speaker, one last follow up question, Does the gentleman from Henderson Yield to an addition question from the gentleman from Pedal I certainly do Representative Grady, since this rule is not yet final and since that it is known that this way that this rule is being promulgated that will most likely be litigated by one state or multiple state in terms of what this rule will mean to America as we know it.

My question is that why are we spending any taxes fare dollars or consuming any taxes payer dollar resource term to actual set up a process that could be deemed as pretty much setting up the energy version of a state in exchange for the affordable care act, I'm confused why we would spend any time, any effort whatsoever to set up something that is going to ligigate[sp?], maybe repelled and then how do we stand in term of litigation, we are actually looking like to the federal ministration that we are complying with the rule they are looking to do. The with respect to the later observation I would give you an opinion even as a lawyer that the fact we're going through a planning process does this going to under cap our litigation strategy as absolutely no bearing on it? We off times plan for things that don't happen. We buy insurance for accidents and results that you don't anticipate happening, but you still plan forward that's all this is, a collective view that we need to plan fourth it's noteworthy that other states are doing the same thing that this bill proposes to do, South Carolina among others, has started into a planning process like this. The idea here is that let's say you're right, you challenged the law and ultimately it's appalled and we don't have a change, a significant change in administrations then we are going to find ourselves in 2016 in basically just turning this over to the department of environment and and natural resources to put together the plan. I'd say to the gentlemen, I mean, look at the breadth of the supporters of this approach, these are not people that normally agree on this set of issues and yet they're coming to us and saying we do K-energy and we this year [xx] believe we need this process and that's why we put forward this bill. The gentleman from pedal is recognized to debate the bill I would really appreciate Representative McGrady answering these questions that really are riding on my heart about this bill, and I just ask the body here to be very careful about what you're considering to do, I must certainly know that it is in the best interest of the actual proponents of this legislation that they think they're doing what is right, but how is actually setting up a state process to comply with a rule that is actually issued by executive feared by saying that we're actually complying with the law to me it's greatly concerning, why are we going to remove any type of friction right now of what this kind of administration on the federal level is actually doing to our citizens. I would say first and foremost let the federal government do what they are going to do and let litigation occur because again this ladies and gentlemen is actually going from looking at your energy in the list cost matters tax you are looking at your energy for what is the list car been cost as you energy, be very careful about what you're doing here today I definitely respect the bill sponsors but I think this is a gross mistake and a very huge miscalculation, I'd ask for you to support, to actually oppose this bill heavily. For what purpose the gentleman DuPont, Representative Dickson rise? To debate the bill  The gentleman has the floor to debate the bill. Thank you Mr speaker members to buy some of representative McGrady's language, which first of all I'm very thankfully and impressed in the, for his efforts here, but unfortunately the state cannot avoid getting caught with this pants down, because he's already got his pants down but not joined in the law suit, secondly to the point of being caught unprepared we're fortunate to have someone like representative McGrady on the floor, he did, he and other people did such a magnificent job with the collage on the spur of the moment and with the way that we handled the coal ash situation being the first in the nation, I would say that I might support this bill if the state would join the law suit, otherwise, I think that this is superfluous, I think it's how the opportunity to the waste a lot of time and energy relative to what people could be doing if they were not working on this.

In the other day in committee I asked how Dina[sp?] felt about it Representative McGrady represented him very well. They basically said that they were mutual, but they were not too happy with going with this way, so I just think that we need to back off and let the folks that will be doing this, spend their time in a much more productive manner than pursuing something that we know ultimately is probably going to be of no use anyway, thank you. For what purpose does the gentleman from Humboldt Representative Herger arise? Debate the bill. The gentleman has the floor to debate the bill. Thank you Mr. Speaker as a sponsor of this bill I want to stand up and make things simple. This on the surface can be a very complicated bill but it is really two options that can happen here. One, after all the court cases are exhausted, EPA implements 111b. That's one thing that can happen, that might take a couple four years, I take three years, I don't know. Or, after all the court cases are exhausted the supreme court or whoever says you can't this, or they just loose interest may drop it, that's the only few things that can happen, either way I look at it. Now, lets assume the first option happens, that they go through the court cases they get through there and the implement something, whatever it is. All this bill does is say, if that happens, we want to put a plan together, we want to put a stake holder group together made up of business folks, made up of folks that are concerned about North Carolina and uniquenes of North Carolina put together stake holder group to protect our economy, to make sure if this law was implemented that we're doing the best thing for North Carolina. Now if we don't do that, we get the federal plan that's the option. If option one happens, they implement rule, you've got two other options to answer that. Either we do own plan, we protect the economy in North Carolina, we protect the power group, of North Carolina, or we get the federal rule. Take your pick, thanks now if option two happens and they don't implement the rule guess what we take all the paper work we do, we throw it away and we don't implement the rule, it's pretty simple so for that to happen which will probably happen which means they implement the rule we want to be out to protect our economy guys we want to put stakeholder group of North Carolina, we don't want the federal government say, "Here you've got to do this. " We want to give them and say, "Okay, if you open this rule, here is what we are going to do. " So I think it's a good bill I think it's a good planning bill, still thanks we haven't done a whole lot before, we haven't planned, which can't let this stuff happen to us. No we have a cleaner as you come through we did a pretty good job there. We need to plan on this, we have the [xx] we have the time to do it, let's get it done. It doesn't bind us in any way. Representative Dickson I told him this earlier keep us from joining from joining the law suit. It doesn't proclude[sp?] us from doing that, It doesn't proclude[sp?] doing anything, all I would say is that we are going to play in and we are going to protect our economy. So I would you ask you to vote green on the bill what purpose does the gentleman from [xx] Representative Speshali[sp?] To speak on the bill. The gentleman has afforded to debate the Bill. His team's colleague who just spoke forgot about that third option This is an executive order, he kept referring to it as a law, when did the constitution give the president the authority to make laws, it doesn't, so that third option is that North Carolina, if you and I had the courage the spine, the backbone to stand up at some point and say, well we just not going to do this because you don't have the authority to do it. Right now, jumping ahead of the game and trying to anticipate what the courts are going to do, does not make any sense it does not make any sense for us to spend time, money, energy trying to pull together something, and I do implied Representative McGraidy and Hager and all the ones that were involved in this to try and look ahead, and I think that's a great idea. We need to look ahead more often, but in this particular case We should be joining the lawsuit, we should be passing a resolution that says we're not going to implement this year in North Carolina. I don't know how many times in this session we've heard whether other states this and other states that and other states are doing it, I chose to live in North Carolina because North Carolina is different. North Carolina is North Carolina. It's not any other states, I don't care what the other states are doing it's fine to look and see what they're doing and get ideas, things like that, but we should never, never use the fact that other states are doing something and follow suit for that reason alone.

We need to make each and every decision based on what's best for North Carolina and the people of North Carolina. That's why we're up here. So again I applaud the bill sponsors for looking ahead, thinking ahead, but I think this is bad business, that we are jumping to something that's being litigated, that is not law put out by Congress, that we really have no idea how this is going to turn out. Let's not spend time, money and resources to implement something, to pull together a plan, that doesn't yet exist in the law legitimately. And I ask you that you vote against this. The EPA issues ethics and it is administrative law that's what running our country now, the president appoints the EPA, the EPA makes up what rules they want make up and then they send that either to all the states and you either fall in line or they don't, and if we do this we're giving them a passive approval we're saying it's okay for you all to do that it's very akin to their affordable care act and  the health care exchange if you want to see them have control over then this is a way to do it then I don't questions the intention of Representative Mc Grady and others that wont Bill and applaud the effort to get out in front of the named issue, but some of the land in this on page two number G up at the top is so open into this says I'll read it to you persons that represent any other entities after that the department determines could provide assistance in the development of the state plan that means anybody they decide to bring in they could bring in the third great class for miss from a a school I may not that's being a little virtuous, but I would urge you not to do this because I don't think we should give them our approval. But this rule goes into effect depending on what date you choose, how much credit are we going they get for the clean up that has already occurred here. As opposed to say like Kentucky start cleaning up, they got relatively easy things so you can do to lower their cabin, and we've got a much harder thing to do. The other thing that's out there and to lay as the possibility of the multi state effort, we could bond with South Carolina and work on something together is a lot of really tough issues here, I don't presume to think that the department of the environment natural osiosis and answer those questions and the most important thing to me is that our constituents that whole breathe from right to left on all of these issues, have come to the three of us and said, we would like a bill that forces a process that we would be involved in, we have put any and every concern we could think of, that we need to address in this bill and I can think it's a common sense and good practice to get out front of an issue and that's why I put forward the bill and I urge you to vote positively for it.  Further discussion, further debate. It's a trade name for it but in the schools settings and we recognize that these things can save lives and they really we needed to make sure that they were available in schools. Well, this is sort of a large connect next step except there is no mandate here this is a, if a business for example restaurant or a business like a summer camp about serving entity, once to have available epinephrine injectors in this bill provides them a way to get there. The issue is you normally prescribe things for individual people but how do you prescribe something for somebody who doesn't know they are allergic, so this creates an ability for particularly child serving entities, but frankly it isn't just limited to just child serving entities, it allows an entity be to acquire epipens, epinephrine injectors that they may use in their place of business, it's got a training regime to it, meaning you just can't have no one trained go out get epipens and use them inappropriately but on the other hand it's got good samaritan liability provision to it basically which says, that in an emergency if the EpiPen gets used you're not going to find yourself with liability for the appropriate use in this setting, and we had a really good discussion in the committee. I'm not aware of any opposition on this, but I'll certainly stand for any questions. For what purpose does the lady from Wake, Representative Avila rise? To debate the bill. What's gone wrong with me? Or, what's happening on here? then my eyes full shut, my mouth swelled and my throat began to close, and because I was I think with my family in town, I made it to the emergency room in the hospital just in time to pass out from the inability to breathe because of anaphylactic shock that's why it's so critical in situations where you have adults who can react unexpectedly to allergies that they didn't have before because they can happen that quick and just that deadly. Am I opening myself up to any legal liability for negligence or whatever because I have decided not to take advantage of this bill? unfortunately, I can't give you a complete yes or

no, I think initially clearly the answer would be no. What you're referring to in law is something called the standard care and you as a restaurateur would be bound to comply with the standard of care whatever that is among all your fellow restaurateurs in terms of how they deal with whatever it occurs here. In theory, after some number of years if everyone of your fellow restaurateurs decide that they want the epinephrine injectors are a vital part of their business and then and ask one of your customers has an allergic reaction and you happen to be the one restaurateur who  hasn't taken that prediction, I'm sure plaintiff's counsel would argue that you have not met your standard of care, but this Bill it does not set that standard care, and if you know my background some account director 20 years ago, the standard affair for me probably wouldn't have included either [xx] or cellphones on long trips, or are still running a camp today, one I had already made the decision I'm putting up [xx] on everyone, and probably is the standard care from summer camps, but I'm also you know, adding cellphones on long trips, so that's why I say it's not a black and white question, it's really an important one, but this bill intentionally does'not try to set the standard of care, that really ought to be set by the restaurant tours of the world for what purpose does the gentleman from [xx], representative [xx] arise? Over the last 18 months, they've had over 200 complaints filed by home owners against roofing contractor, that's over 11 a month, and what this strives to do is narrow down those bad actors from putting those high pressure sales on consumers. We all know those this is where a contractor comes and promises the roof, and they pay and lose money and they never get the roof are repaired, what this Bill does is it changes the act where those contractors who come in and offer to provide for a free roof based on insurance claims or something, and then all of a sudden the insurance don't pay those consumers are protected. This Bill does three things; it requires a written contract for a roofing repair, it prohibits certain unfair and deceptive trade practices and the third, it provides for the consumer, the home owner to have a right of insulation if they enter into a contract based upon a perceived or a promised insurance payout, and when that insurance does not pay out, they're not bound to that. It provides a notice of cancellation three days after they received notice that they for which they have depended upon they enter into a contract that the insurance proceeds will not there. They have a notice of cancellation in three days, it's passed unanimously in comedian I'll urge your support. For what purpose does a gentleman from union representative broadly arise? The gentleman has afforded to debate the bill.  I just want to give everybody an example of this and what you see [xx] and I do support the bill when you have a hailstorm for example, and a lot of roofing damages is done to the houses, you'll see a lot of roofing contractors come up and they come from everywhere and they'll go from door to door and say I'll fix your roof for x amount and a lot of time there are imbalance and fix a little bit more than they need to fix I guess you could say and fix a little bit more than what they need to fix, it's really a high pressure sails and it's because of an event that happens that sparks this and I really do support the bill and I originally thought was a licenseing bill but it isn't its just a good consumer protection bill. To asked the bill sponsor question  The gentleman from union yield to the gentleman anyone from Blaine Certainly Yields Representative [xx] who does the contract, who is responsible for the contract? If in about being taken their customers who trust who with the contracts, who is responsible for issuing the contracts the roofing contractor has to provide a written contract outlined in various things, or else the contract is null and void the home owner will not be held to that contract. The other part of that is the [xx] and proceeds have to be held in trust by the contractor for that period of time and it constitutes the violation of the unfair and unaccepted trade practices that which go for terrible damages Does the gentleman yield to an additional question. So if am a roofing contractor am I required to issue that contract before?

Is this allowed as going to require me if I'm in the rhythm business to issue that contract, is it that what you are saying? Under certain circumstances, if you are a licensed general contractor you are excluded underneath here. If you are a sub-contractor to a license general contractor you are excluded from here, licence and board all ready takes care of that so what's happening here if it's a small roof of [xx] under $750 is written contract is required there. For other from a pair of contracts or a contract is required because of the notice of cancellation Does the gentleman yield to an additional question? He yields. That's is a great point. The point is a written contract is so that the roofing contractor has put in notice of the right to cancel once the home owner is made aware that the third party of the insurance company for which they had depended upon supplying funds to replace the roof has made a termination that they will not do that so that's a change condition. That risk falls on the contractor who goes ahead and does that work.
