Now we go back to the calendar. house bill 792 the clerk will read.companies appointed to resolve the difference between the senate and the house representative on house bill 792 the the enire Act to protect the public from revenge, posting online or making it a criminal offence to disclose certain images for which there is a reasonable expectation Observance of privacy and to meet indecent exposure to have occurred in five premises or criminal offence. So judicial want a committee substitute without observing 315 4th edition and graced 8th, 515 submit the 500 report. The conferees recommend that the Senate and the house representatives adopt this report. The eight conferees approved the report September 14th, 2015, compliments for the Senate, Senators Jackson Chair, Senators Bethwed, Randleman, Curtis, Robinson and Colick. For what purpose does the gentleman from Mecklenburg[sp?] Representative Brian rise? To make a motion to adopt the conference report and to speak to the conference report. The gentleman is recognized for the motion, the gentleman has properly

motioned to adopt the conference report, the gentleman now has the floor to debate the motion. Thank you Mr speaker, fellow members this is a bill we passed [xx] as revenge postings that you all may remember well we passed unanimously through the house and it was sent to the senate, the senate made a number of that I'll run through briefly and then the conference committee also made a few additional changes. If you pull up the report just a couple of the highlights are the changes all of which we in the conference committee found acceptable there are some definitional clarities to make it clear that everything applies to both sexes, it sort of reorganize as is the elements of the offense. One of the things we did with respect to the offenses the original bill we passed through the house required that a person know or should have known that the depicted person didn't consent to the disclosure. We changed that requirement to be that the person disclosing him is literally had to have the affirmative consent of the depicted person and this is really to make it easier to prosecute, and just as a reminder for the backdrop of this you have to be doing this posting for the express purpose for the intimidating, harassing that's always the backdrop but made you have to get the affirmative consent of the person so it makes it a little bit easier to prosecute. One of the other things we get with respect to civil action that someone could bring on this, we clarify that a person has one year after the initial discovery of the posting, so if someone would post make a revenge post when a couple breaks up someone posts something, that person, when they find out that there's been a post he made that there was four of this revenge purpose that they didn't consent to. They have a year to bring in the claim. Now as you can imagine someone might not find out about a posting. So it keeps it alive as long as they don't know about it, but no longer than seven years after the last posting. So if there was a posting made eight years ago there was no further claims if it wasn't found out there wouldn't be any further claim. One of the things the senate also dared, was those all under 18 all original house build had. It was a felony in all cases This revise it to make it for those under 18. It's a mister-mine the first time, a felony the second time, it's a felony for anyone over the age of 18. The other changes that were made and if you're looking at the Bill, this are basically in sections 2, 2.1, 2.3. This all relate actually to a situation that was going on in Mecklenburg that some of you may have heard of, there was a guy standing in his doorway on private property exposing himself, but there was not actually a law that allowed that to be a crime, to pursue, to go against that person for doing that. So there's about three different situations all of them relating to exposure in private locations. Most of our laws regarding exposures of different types relate to being in a public place. This allows there to be claims related to exposure in private places. One of the other situation, this occurred, I think there was a minister who had invited a homeless guy into his house that guy ended up exposing himself to someone else in the House and because it was on private premises and the person was invited, there was no rights to pursue that person. So these fixes most of those issues. I think there was also a study bill put in regarding people having superimposed images of people exposing or depicting sexual conduct that was requested by the Senate that we didn't have any problems with. I'm glad to answer any further questions. Further discussion, further debate? If not, the question for the House is to adopt the conference report to House Bill 792. Those in favor will vote aye. For what purpose does the gentleman from Cumberland, Representative Floyd rise? Mr. Speaker? For what purpose does the gentleman rise? Inquire of the chair. The gentleman may state his inquiry. Mr. Speaker yesterday I attempted to suspend the rule and I wanted to know is that possible to do that today since we agreed upon that it will come forward. The gentleman is in order to make that motion. And just to answer, the Chair has received a number of questions about what the practical effect of that would be. If the gentleman does make a motion to suspend the rules and if the motion prevails, it would be the intent of the chair that we have session tomorrow afternoon. The chair is considering 2:00 P. M but we'll even consider a later time if members would like to give the members obviously the [xx] of the full amount of today and most of tomorrow to continue to review the budget. And we'd also be the intention of the chair that we have the third reading on the bill, on Thursday morning sometimes probably 9 AM, 10 AM, during normal business hours. If we don't suspend the rule and we continue on, is the chair's intent that we have a vote on the budget on Thursday and in the very early morning of Friday, probably after midnight and that is simply because we were right up against the CR, we want to get the budget delivered to the governor as soon as possible. Mr. Speaker. For what purpose does the gentleman rise? I rise to suspend the rule of 44D into the end. Is the gentleman aware pushing to suspend the rule for the purpose that the budget may be considered for second reading tomorrow. The gentleman's not asking they'd be heard for today, but they be heard for second reading is that correct? Yes. The members has made a motion to suspend rule 44D so that the budget bill would be heard for second reading tomorrow with third reading the following day. For what purpose does the gentleman from Durham, Representative Hall, rise? To speak on the motion. The gentleman has the floor to debate the motion. Thank you, Mr. Speaker and I'm sure that most members and probably the public as well who were waiting on this bill received it at approximately 11:42 PM 11:45 PM last night when it would have been posted. I know some folks have probably a clairvoyant capabilities and are able to make determination about the details of the budget before it is even published but most of my constituency don't have that ability and have not had a chance to review it. We have not as a carcass had a chance to have a full briefing from legislative staff and certainly we'd like to know what we're voting for or against, as member sit's body to do our due diligence. I would that until we have at least have had full briefing from the staff, this motion will not be approved at out of professional respect for members of the carcass and this legislature who need to read what the terms of the budget are. I would say, we would be committing borderline legislative malpractice to say we will vote on a bill that we haven't seen for 24 hours or vote to have a vote on the bill that we haven't had full briefing from the staff, we know the staff is briefing the senate and they're in fact trying to vote on the bill today and learn about the bill, and they're not available to complete their briefing for us today. So I'd ask members to oppose this motion to suspend the rule certainly at this time, until we've had a chance to at least to be fully briefed by staff, so that we can do our due diligence and legislative duty to our members. Speaker, for what purpose does the gentleman from Mecklenburg representative Jeter rise? Inquiry of the chair. The gentleman may state his inquiry. Has the chair briefed the democratic Carcass on the budget? I apologize, could the gentleman repeat the question. Have you briefed the democratic Carcass on the budget? Actually I did I had an opportunity to meet with the democratic Carcass this morning as well as our Carcass yesterday, I'm glad to have any more meetings may be necessary. For what purpose does the gentleman from Wake Representative Jackson rise? To speak to the gentleman's motion. The gentleman has the floor to debate the motion. Thank you Mr. Speaker. First of all let me say I commend the majority for the three days 72 hours hour rule, I think whats going on next door today is a travesty, okay some of those people didn't get the budget so I had to clock when they came in this morning, however I'm going to ask you not to set the rule aside as we do read this, maybe its my legal training I have

been fast out by none other but Representative Howard before for voting no on a 50 page bill and the only reason I can give for voting no is I haven't had a chance to read it yet, and I promise you by the time we vote Thursday 10 o'clock at night or whatever I will have read this entire thing. I will not have understand it but I will have read it. Staff came in and made a presentation today, they got through the finance portion, and the K212 portion in two hours, and the speaker was gracious enough to come and talk about some of the bigger pictures, but we still haven't even gotten into the special provisions and I'd really like to read it, and I think there is other members who really like to read it and I know that it's very important to people back home that I do do my due diligence, and so I'd ask you to give me that opportunity. For what purpose does the gentleman from Wake, Representative Martin, rise? To debate motion. The gentleman has the floor to debate the motion. Thank you, Mr. Speaker. Members, let me add that my friend from Wake County, Representative Jackson, will not only read the budget, he'll tweet it too. Members, several years ago when the people of North Carolina in their wisdom set my party in the minority, I've had several discussions with my friends across the aisle on some of the changes that the majority party has made to our process, to our procedure here in the House of Representatives. And I've had some good debates and we haven't come to an agreement on areas where we think ya'll have moved forward and made improvements in areas ya'll stepped backwards. But when my Republican friends point out to me that they have implemented this requirement that the budget be out there for three days for members and for the folks that members serve to see, I have no response. That has been a significant, tangible huge, improvement to our process here, I hate to admit it, but that is a wonderful thing you've all done that benefit us and benefit the people of North Carolina. It's one of the things first of all that sets us now apart from the procedure that we had under my party's control but just as important now, it's it sets us apart in the house from those heathens over in the senate. I don't know if they are listening I still got bills over there I'm sure I'll hear from senator Apodaca on that one, or perhaps I won't hear from him. But any case it's a great thing that you all have done. and the people of North Carolina do appreciate it, and they know that there is a different between us in the house and the senate it has immense practical value. I'm in contact with folks in my district from the city of Riley and also Wade county, I'm also in contact with folks who through out the state who have their interest potentially affected by this budget. They're not sure yet, and they're probably not going to be sure what the impact on them is tomorrow either they do need the addition time to come to better idea on the impact and give input to me and the other folks let's serve them, now anyone out here, they complained about the small number of members of congress who actually read the ObamaCare Legislation should probably oppose this motion here before you. I'm not sure that three days is enough to give all of us other than representative Jackson the time to read 400 plus pages but we'll get a lot further and we'll also be able to hear from a lot more of our constituents, so that's the practical value this has to really contribute to good legislative process, but let me also talk about the very important symbolic this role has. I think all of us, democrat, republican or urban, rural, veteran legislature versus new legislature, will all agree that the people of North Carolina are loosing faith in their political system or you can say that they lost it a long time ago, and I think the three day requirement is one of those things that is not in step toward rebuilding bond of trust that we have with our constituents. They are looking to us to be seen to taking the time to consider legislation carefully, now what's part of the frustration I think with many Americans over the passage of Obama care is that they did not think that their members of progress had time to look at the legislation, so too with a $22 plus state budget, we need to show our work with the people of North Carolina, to show that we take their business seriously and we're going to take the full amount of time to do that, for those reasons, I oppose this motion. For what purpose does the gentleman from Claven, Representative Speciale rise? To speak on the motion. The gentleman has the floor to speak on the motion. Ladies and gentlemen, we did

do something good by putting these three days in here to look at the budget, there is a lot in the budget. When it left here, it went to the senate, it came back, to us twice as big we did get a good briefing I will say that, okay, but again, it is a briefing and the label[sp?] is in the details and we need to look at what we're getting ready to vote for. It's not good enough for us to think that we can do something, doesn't matter we've been briefed that's good enough. We are here not representing ourselves, we are here representing 80, 000 other people, and because we are in a hurry and we want to go home, we will return to suspend the rules on something that we set up because as republicans we got upset when the other party was in power, and they brought to us a budget or a bill with insufficient time to be able to go over it. To be able to look at it, read it, and understand it and look at it and complain about it and whatever it is we needed to do. Well, we gave ourselves the time, three days. I go through the bill, line by underlined page by page, I've already been going through mine. That's what I spent my morning doing. I want the time to be able to finish looking at it. I'm looking at what appears to be a good bill, but again I don't have all the details I've got the basics of it that was explained that I want to read the details, I want to look at the policy, I want to underline and highlight and make sure that I understand because the bottom line is I'm going to go back to my district just like everyone of you and have to answer questions. And so if we can't make the time to go through this budget line by line. If we don't have the time to do that we're going to do voting on something and at some point later we're going to be asked a question and we're going to say, well, I didn't know that was in there because everyone of my predecessors has said that to me when I ask them question about the budget, I didn't know that was in there, I'm not going to go home and tell the people that I represent the same I'm not going to tell them I didn't know that was in there but I'll need time to read it and you need time to read it and we did a good thing by making it 72 hour requirement and I'm asking you to please do not support this motion and allow those of us, if only one person in this chamber needed that 72 hours we should be courteous enough to give it to them, inspite of our own personal preferences of get out of here, we've been here eight months, one more day is not going to make a difference and we'll be back next week anyway. Please do not support this motion. For what purpose does the gentleman form Nash representative Collins rise? To briefly debate the motion. The gentleman has the floor to debate the motion. Well I agree with part of what my colleague representative Jackson said because like him I voted against bills because I didn't have time to read them I do like to read what I'm voting on. I've every page of every budget I voted on, representative Stan can tell you, he's caught me back when we would get the budget and then vote on it the next day, he's caught me when I was sitting behind him a couple of sessions ago reading about the last pages at the beginning of the session as we were getting ready to vote it, because ti took that long to do it. I'm going to support this motion and I will as I've always done read every page of the budget. We started, I would advice you what I'be started doing with some other folks, get together with groups of people, like minded people, people who think like you start tearing this apart. As soon as we can get our hands on it yesterday that's what we began to do. I'll be going back in to session with some other people at 2:30 this afternoon to continue to the same thing and if we continue to do that through the rest of the day and through whatever part of tomorrow we have and again I would prefer maybe 5 o'clock tomorrow afternoon, but whatever time I've given, that's what we'll do and we'll go through the whole thing and I will say unless you've got a photographic memory I don't care if you take two days or three days somebody still going to be able pull something out on you that you don't remember unless you've got a photographic memory reading 500 pages in three days. I dare anybody in here to say that we'll remember everything we read if somebody asks us a question and they can't still stump us. I think that's an admirable goal but a goal I don't think any of us will reach but will spend the next couple of days as I have the last 24 hours going over this thing in excruciating detail and I'll be ready to vote tomorrow so I'm going to support the motion. For what purpose does the gentleman form Wake, Representative Stan rise? First to probably make an inquiry. The gentleman may state his inquiry. Mr. Speaker, if the motion were to pass would you will be willing to say that the session tomorrow will not begin until at least 5 o'clock in the afternoon.

Certainly would and would even entertain 7 P. M if folks want to do it. No issue there. Then can I speak on the motion? The gentleman has the floor to debate the motion. The third legislative day of course assumes it's the budget and in this case the third, the final reading would be on the third legislative day because packs increases are in the bill or B increases are in the bill, it has to be voted on twice, so we actually have the same amount of time as contemplated, I do like to go back a little bit into ancient history to explain my thoughts on this how many of you all were here in 2004? Well, well, well at the end of that session we we're do the conference report on the budget and speaker Black actually wanted us to vote on the conference report before the money report was actually passed out, and this was about 10 or 11 O'clock at night and I was a little of the minority party and that I went in favor with the other guy and I said Mr. Speaker, Mr. Speaker please let's have 15 minutes to just look up a few things and he gave us an hour, and I really appreciated that because in that hour I was able to read that 500 pages, but anyway I think between now and tomorrow night we can read and find the things we're interested in. For what purpose does the lady from Orange representative Insko rise? To debate the motion. The lady has the floor to debate the motion. Thank you Mr. Speaker, members I don't think of this as our budget this is the peoples budget and I work for the people. This is the report that we're giving to the people that we work for and I think the people that we work for have a right to be able to read it and understand that before we vote for it. I hope you vote no other motion, I I don't look forward to be in here to being here for the night, but I take a job, I don't ask what my hours are, I want to do the right thing. I hope you vote no on this motion. For what purpose does the gentleman from Rutherford  Representative Hager rise? Debate the motion. The gentleman has the floor to debate the motion. Thank you Mr. Speaker. I did a quick calculation looked at the number of hours we would have looked at this budget since it came out yesterday last night if we third vote at about 7 O'clock on Thursday, a 68 hours, so its four hours difference from third reading from what we will be talking about right now so I think it's ample time to look out at certainly most of you have been approached by constituents already that have had a look at this budget something they didn't like or did like. There has been [xx] three or four walking over here, saying what they like and what they dislike. [xx] on the TV last night saying what he didn't like about it, so he must be where the prognosticators tell how worse the budget. So a lot of folks already looked at it, and again the point is you get 68 hours from the time we do third reading. That's a little bit of time, I think I can read it. We've already been through with the money market this morning already, we are starting on the budget as this afternoon so I think is the ample time, I think our folks want to be efficient, they want us to be effective so I suggest you get it out of here so we finish this discussion get your budget, get all order some lunch and start reading it. For what purpose does the lady from Cataret, Representative McElraft, rise? To speak on the motion. The lady has the floor to debate the motion. Thank you Mr. Speaker, members, I just wanted to remind everyone that we've looked at the house budget for months, we look at the senate version for months and there is only a couple of things that was on either one of those budgets and it will try to be easy for the speaker or representative Dollar to what those couple of things are because if all of you had done your [xx] like I should have, you would have perused over the past two months we've had these two budgets the house in the center version. You would have perused every page of most of those and in that way you would know what the difference of the two are and you could vote for this budget or vote against it. The other thing is in the conference report you can't make I can understand the three days if you needed to make amendments. There are no amendments to a conference report so there will be either a yes or a no vote and there's 1400 hours and 1400 minutes in a day and there's about, if it takes about three minutes to read each page it's going to be about 1500 minutes so in two days, in 12 hours you can read every

page if you haven't already read it as most of us have thank you. For what purpose does the gentleman from Rowan Representative Warren rise?  To speak to the motion. The gentleman has the floor to debate the motion.  Colleagues since I've only been here three terms I believe her to pass through the integration and I got really care to hear about anymore, it's not important what's happened in the past, what's important is what we do today. I do support the motion. I think that if we follow the speaker's first hotline and have the second vote at 7P. M. And then on Thursday have the following one at 9A. M. I think it does give ample time for both sides of the aisle to form study groups, divide the budget up. It's a big monstrosity file, almost 500 pages and also see how anybody's going to read through it individually over the next three days anyway. So as they form study groups, assign different parts of the budget and get together and analyse it. We have time to discuss it Wednesday before the vote and again on third vote. So I think it's time that we realize that we still have loose ends to tie down after this budget's voted on and we need to go home. Our constituents need certainty and we need to provide that for them. Let's quit politicizing this, let's be realistic about it, let's vote for the motion and move on. For what purpose does the the gentleman from Gilford Rep Blaster rise? Inquiry of the chair, the gentleman may state his inquiry Mr speaker, if I understood what you said earlier about the timing obsession if this motion prevails, it will be 7 O'clock, which means, most of us probably have to miss one of the greatest reality TV shows ever coming on tomorrow at 8, with the reality show superstar involved in a presidential debate. I'm wondering if that schedule might be amended to allow this kind of entertaining TV to be viewers as we do our due diligence on our presidential vote next year. the gentleman wants to have his aye pat on the floor, the Chair won't call a [xx]. For what purpose does the gentleman from Darhum, representative Haul arise? To speak on the motion. Gentleman has the floor to debate the motion. Thank you Mr. Speaker, and, it's too bad that our discussion about an important instruments like the budget has now kind of degenerated into a joke about our institution. We've got a conference report, some schools authority expressed this will, it's a conference report, you can't amend it any way, so you shouldn't worry about reading it. It can't be amended as a conference report because why? Because that's our rule. Now we are saying, we are bound by that rule, but we are going to suspend the rule that will provide the public, a chance to what's in the conference report it contains. I would say as a majority, as a super majority, many of the members of this house would want to say we can do whatever we want to do anyway, so why should we worry about fairness and process. Let's just do whatever we want want to do, let's make some rules, let's throw them out to wonder, whenever it's convenient for us, we have the super majority even speaker Black as representative Stan recounted history from centuries that go or decades ago wherever it was if the speaker Beth gave him four times as much time as he asked for four times is much time as he asked for. So now we have a super majority guaranteed success on whatever we agree to and we will be grudge the public a chance to read and interact and we said the reason for that is we can't change it way because that's the rule but we're going to change this rule. I think our rule have some significance and some meaning, we debate on them and worked on them before session and during the post part session I think we hit two versions of it, came back several times to try to get the rules of this house correct before we started this session and now we've degenerated to the point where we're saying, I like this one, I don't like that one. That's about this one, it's not about that one, it doesn't matter we have the votes. Folks in this role of super majority I think you have to be extra cautious about what you do with the power you have and I think you should be extra cautious about cutting off the opportunity of the lesser partys number that's the part in numbers opportunity, to give debate to this instrument that's

going to affect North Carolina so much. Finally the much policy in this budget, and it's not just about the numbers, there's a lot of policy in this budget that was not in the house budget, that was one of the objections we had when it left here, and for us now to say we don't want to examine the policy, we don't want to understand we just to vote and go home so that we can come back next week. I think it's a very flimsy excuse, I 'd hope you'd be better than that and expect more of us as members of the house than that and expect more of yourselves as super majority so I'd ask again that you oppose the motion stick with your own rules. I think if you go back and look you all voted for your own rules ad to now say you don't want to be bound by your compact you made with the citizens of North Carolina I think you're probably selling yourself short. I'd ask you opposing. For what purpose does the gentleman from Rutherford Representative Hagar rise? Debate the motion a second time. The gentlemen has the floor to debate the motion a second time. Thank you Mr speaker I think most of you if you don't have on your desk you can go back to your office and get this book. I got on my desk called The Rules Of the House by representative Timbo speaker 2015 as you'l have it you flip to the back and just look at our rules and the index of our rules. It's got a rule called the suspension of a rules. So there's a rule just in case we have issues. There's rules or just in case we have some circumstances we need to take care of. Representative Hall indicate we are doing this willy-nilly. Guess what there's a rule for suspension. That is why we were so smart in doing this, is in case we got a problem we can suspend the rules and move on with the business of this body, and it's up to this body to figure that out. These are not something we are doing willy-nilly. This is not a departure from our rules that we all said that we were bound by, we are all bound by this rules but it allows us to be able to suspend them when we need to to be able to move on and do our business. This is not willy-nilly as representative Hall says or indicates that we are doing something outside the rules that's not the case. Case is we are following our rules, we are doing the right process, and I commend our speaker, and I commend the motion maker for bringing this forward. At the end of the day we'll decide whether this rule gets suspended whether we move on whether we have 68 hours or whether we have 72 hours, and that's really the question. I think what I would ask minority parties to do is what I've asked the majority party do. Is leave here and read the bill, it's all we need to do. We know things get put on conference [xx] that weren't as in the beginning, but that's not the problem. The problem is I don't know and you don't know, what of that senate budget and what of that house budget remains. I don't care what was in the previous house budget, I don't care what was in the previous senate budget. What I do care is what's in this budget. We need to time to read it. And again even if one member here needs those three days, we should be courteous enough to individual to allow

them to take the time that they need to understand it. I'm asking you to please vote against this motion let's take the three days I want out of here just like everybody else but I want to make sure that we understand it. I think we've already heard several reasons why it is a good motion, and I would maybe just point out two or three things that we haven't really heard about but one is that the governor is going to sign this budget assuming that it pass, and I think it would behoove us to go ahead and finish the process at least a day before the CR runs out, and at least give the governor the respect to go ahead and send him the budget on Thursday, that has to signed by Friday at midnight in order for bad things not to happen. I think it's interesting that many of the people, and I respect what we just heard and I know that there are people that diligently want to make sure that they read every single word of this budget. I was struck by the comment and I appreciated the honesty, that my friend earlier who said, I will read it all but I really won't understand it all. I think if we are all very honest about it, we do depend on some level of trust, and the fact that every member of this room, has a pretty good idea what's in this budget, because, as was said earlier, the house in the senate budgets have been around for a long, long time. You know you would think by some of the debate that we have heard earlier today that we were just all somehow in the dark, until this, finally the conference report comes out and it's all something we're starting from new and we've got to read. Ladies and gentlemen we all know that's not true, there's been a lot of I think political postering and some, a little bit demagoguery, but it's okay. This is politics, we've heard a lot of good speeches today. But the truth of the matter is, folks it's time for us to move along. I hope that will pass this motion. I think there will be plenty of time, if you don't trust the people, that put the budget together. If you don't trust what you have heard from staff, if you don't trust what you've heard from leadership, I encourage you to do what representative Collins said earlier. Find someone that you do trust, sit down with the group, everyone takes some pages and get together and tell other. If you think you know it all, then that's great. Try to read every word, try to digest it all and just rely on your own thoughts. I wish I was smart enough to do that. I am not. I don't have to trust a little bit what others help me with as I read through it and I've to sit down from page one and get through the last page and say well, I was all for it until got to the last page but then I read the last page and somehow I can't vote for it now. I don't think the budget outcome is going to change one way or another because we do it a few hours earlier or  few hours later. Folks, people in this chamber do have lives, a lot of people in this chamber have jobs outside of here. Some people have to work, seriously I think we need to respect that too. We've been here for a long time and it's time for us to pass this budget or get on with the vote and doing it a few hours earlier is not going to hurt. I hope you will support this motion.
