Mr. Speaker, the Senate has made a couple of changes to this. Some are sort of tweaking the bill as it was originally intended to deal with the school board subpoena powers, and I think that's something that maybe was some conversation with the Senate that we could resolve satisfactorily. The other part is more problematic, there's some of us who believe that the Senate has essentially put back in this bill the provisions somewhat modified to do exactly what this House voted not to do earlier this session, and I think at the minimum we ought to discuss that in conference, and I would ask the House to vote Green not to concur. The Clerk will read the amendments proposed by the senate. Senator Soucek moves to amend the bill on page one line three by re-writing the line to read. For what purpose does the gentleman from Cumberland, Representative Glazier rise? To debate the motion, Mr. Speaker. The gentleman has the floor to debate the motion.  Thank you Mr. Speaker, and I rise to completely concur with Representative Blackwell on this, I think not concurring is correct. I would just go a touch further and say what the Senate it is done in section the amendment from Senator Soucek is absolutely forbidden by the rules for us to reconsider if you look at house rule 42, effective defeated bill, it's says subject to the revision of sub section B of this rule after bill has failed to pass on any of its readings, the contents of that bill or the principal provisions of the subject matter shall not be considered in any other measure originating in the Senate or originating thereafter in the House. Since we have in the way a step earlier this session of defeating the bill on this exact subject matter on the floor our rules absolutely and without question bar this provision from being in the bill and because I think that is a really clear and I think the parliamentary authority are not even ambiguous on this I agree completely with the representative Blackwell and I think we lack jurisdiction on section two and I hope we can fix section one with this house is think passed post unanimously and I encourage the motion not to concur.  Mr speaker, what purpose does the gentleman from like representative Stan Ross Does the gentleman from Cumberland yield to the gentleman from Wake? One the conference did adopt an amendment that the house adopted to the declaration by court of the [xx] but more importantly is what's not in the bill, this house originally declined to adopt a learned amendment by Representative Rena Turner and the senate in its wisdom the conference decided it's right representative [xx] was right and we should do what our clerks tell us to do. David and Pate, senate bill 273 appeal to the entire [xx] to authorize flexibility and waving interest of motor vehicle taxes for tax years prior to July 1st 2013 general [xx] For what purpose does the lady from Wilson representing Martin rise? To debate the bill The lady has the floor to debate the bill Thank you Mr. Speaker, this bill originated with our Pitt County delegation, while with the county commissioners requesting that delinquent registered motor vehicle accounts that they would have some flexibility to waive some old fees. This only affects taxes that have fees from 2005 to 2013, in 2013 we moved to the tax and tag program so this is no longer an issue and this just gives them some flexibility to kind of clean up there books and have some authority to waive fees when it makes sense.  I believe if there's an amendment to be heard Mr. Speaker. For what purpose does the gentleman from Nash, Rep Collins rise? To present an amendment.  The gentleman is recognized to send forth an amendment. The clerk will read. Rep Collins close to amendment Bill on page two line 12 by deleting the phrase any other provision law and substituting in GS 105-380. The gentleman has the floor to debate the amendment. Discussed this amendment with Senator Davis he's fine with it, it was something that actually answers two issues that were brought up by Representative Stam and myself respectively during Finance Committee. The first issue there, the first two lines of the amendment, make this a little more specific, Representative Stam and I agree with him, doesn't like the generality of despite all other provisions if there's

another provision that deals with it let's name it and say that's what we're we're exempting or making an exception to. The second one, I like and dislike the title of the bill the first few words are AN ACT to authorize flexibility in waving penalties and interests. I like flexibility as long as it does't mean the flexibility for the friends of DMV and the County Commissioners in order to get theirs waived and if you don't know anybody you don't get yours waived, so we put language in here that the county may adopt a resolution to create a uniform policy to allow the reduction of [xx]. That way it will treat all citizens the same and it's done who you know in that county you get the same treatment. I see senator Dais nodding his head in the back so I'd appreciate if you vote green on this amendment. For what purpose does the does the lady from Wilson representative Martin? To speak on the amendment. The lady had the floor to debate the amendment. Thank you Mr. Speaker and I concur this are good technical changes to the bill corrections on clarifying the statues that we're referring to and infact county Wooden was planning all along to it that's the policy, so no conflict there. Thank you very much Mr. Speaker and members, the house do not change the content of the initial bill we sent over which was to fix an issue in the civil contempt area or in the contempt of Court area but it did add the request of Senator Richard and then an amendment at the request of Senator Robinson to deal with an issue of allowing a Jury exclusion for full-time students who are out of state or otherwise taking exams so that then can then serve later but it created an exemption to deal with that problem that wasn't in our Jury Excusal Statute and then Senator Robinson did I think correctly study of jury excusals generally because those things have changed since they first were prepared on the Statutes those were the only two changes they were unanimous on the Senate side I know of no opposition.
