This is a local bill, the first part of it is for the city at Trinity it reduces the size of the city council from eight members to five members, and reduces the term for the mayor and the city council members from four years to two years The second part for the city at Greensboro has already passed the senate, but there's been three changes which I think read the bill. The first one is that the redistricting can be altered after the Federal Census in 2020 by the city council it also there was a technical correction, the mayor will be allowed to vote until the new council was sited and then after that the mayor will vote only in a town and the following day has been changed to give a little extra time to term to July 27th at noon, and it closes on noon August 7th, 2015 prayers[sp?] for your support and any questions I'll be glad to answer. While we did this in 2010 past African American into districts against out will. This legislation  is an attempt to once again threaten those strengths of African American voters with regressive redistricting. Haven't you as Republicans done enough to my people because I can see you don't consider them your people. Senator Wade's excuse for proposing Senate Bill 36 was that power in Greensboro was packed into downtown. Well this bill not only impacts several elected officials who were elected none-partisan in the downtown area, but it also impacts two African Americans, the first African

American woman ever elected mayor in the city Greensboro by both parties, and another African American city councilman. Rather than increasing opportunity for a people who has been denied rights in this country for centuries, you decrease the opportunity for representation by undermining the strength of African American voters and all voters in Greensboro. I'm asking you to vote this legislation down I know that you represent your party, but this ought to be about people and the request of the people. The majority of the people in Greensboro have said no. They want a referendum. Give them the opportunity to exercise their rights as we give to anyone. I hope you will oppose this bill. Senator Wade has the floor to speak to the bill this Senate has completely discussed this bill before. You supported it then. I ask for your support now there was a poll done by a reputable paper in Greensboro, and it found that most people wanted the change also the size of the paper really doesn't matter. They are paying for a poll lot to do it and use of correct sample. I would say that since then we've had the mayor actually the principle come out and say we've really lost focus for the city council. I think this party it needs to do everything they can, to help Green Spa regain their focus, and move forward, and be prosperous in this State and I think this bill will help do that. Work a little slow on her, finger point over here on the button, appreciate the attention of the senate I wanted to talk specifically about section 13 and 14 the riparian buffer sections they address two specific river basins, the Neuse river basin which hits Newbern and Tao Pamical river basin which comes out little Washington for those of you who other parts of the state and they both run into the Permical Sylum, these are precisely rivers in which there were massive fish kills in the 90s early 2000s which helps us to focus attention on water quality and the sounds, buffers are the cheapest and the most defuse way of keeping drinking water clean its spreads the pain a little bit along anybody who touches the river keeps 50 foot of vegetation on the side of the river and that acts as a screen to get out pollutants and harmful pollution into the river understand that this river basins provide drinking water for people in East and North Carolina all the way to the coast and their are federal requirements as to how how clean that in water must be and if the water quality degrades which it will if we get rid of the buffers then other sources of pollution whether it's agriculture whether it's point sources industry whether it's municipalities though their water systems waste systems they are going to have to spend more money to reduce their share of pollution into the riverbed so what we're doing is transferring costs from the cheapest and most diffuse way of keeping our water clean to other industries, point sources, to farmers and to tax payers. The [xx] sound is the second largest wearing an attire in the United Sates, it's one of the best source of fisheries in the nation. We need to be exceedingly careful with that water and eliminating the buffers for essentially 90% of the land that aborts the tall palm[sp?] and the news is a major step backward for clean water, clean drinking water in North Carolina. I have talked to the bill sponsor just this morning because this bill, I just read it last night. It came through a committee and this was a new provision for me and I've shared an amendment on this provision because there's another section, section 15 which directs the environmental amendment[sp?] to look at precisely this very question, to look at the issue of Riparian Buffers and so I think the prudent course for us is let's have the EMC Look at the riparian buffers particularly it relates to the news on the program before we take this fairly aggressive a almost radical steps of eliminating buffers and most of it is in North Carolina riparian buffers, so though sponsor has agreed to look at this issue of the weekend I'm going be objecting before agreeing I won't offer now I hope that we come some accord on this issue because I don't

think any of us have an interest and having both our drinking water more polluted and damaging the particle sound and estuary that is there. Thank you senator if you'll be patient with me and look at section four which deals with the the fetch wrapping subsection I there is an exemption from the zoning regulations pertaining to signage under this article is it possible Senator, that a property owner could accept signage let's say for a gentlemans' club or an alcoholic beverage right across the street from let's say a residential area, a church or even a school? Senator Ford, I appreciate you bringing that up and we have talked with Senator Jackson about that, and I'd thought there would be amendment coming forth. Do you have that Sir? Yes sir Senator Wade, I want you to take another look with me here briefly at section 12 notice prior to construction, and I think it's a nice courtesy to have two residents and to folks who live next to public construction. My concern is based on the way that language is written if a, let's say the city or the county wanted to provide other connection for someone who's on on well water and they have to move back close and equipments to dig the trenches will that customer under this bill have to wait 30 days to get their water tapped into public water, even tho it wouldn't take 30 days to do the installation.  Mr. President.  You have the floor Senator. Senator Ford this was put in for repairs such as someone decides to put a bus stop in in front of your business and you're gone, you come back the next day was there, and you didn't have any notification it was happening, and you not even on the bus line. It was for that notification and we could certainly check on the issue you raised because I know senators Stan is going to object to third readings if you are Okay with that we'll check and make sure.  Thank you madam.  Senator Jackson, for what purpose do you arise? To speak on the bill. Senator Jackson the floor to speak on the bill Respectfully, I would like to add to the list of things that we're going to check on between second and third reading and Madam bill sponsor, this will pertain to section five, it says if a permit submit the prominent application or any type of development, and rule of ordinance changes in the time of prominent application submitted and permanent decision is made and proper time can choose which version. The scenario which I'm thinking about  is when it is announced that the ordinance will be changed in six months forward, and that produces a flood of permanent application. The question is what constitute a permanent application? My concern is that, if we don't specify what is sufficient to constitute a permanent application, we're inviting some needless allegation down the road, when the question is, were certain projects grandfathered if they were submitted but on up game or submitted missing certain documents? humans that are typically included, so

I did have a n amendment here, I don't think it's sufficient as far as definign that term and there is something I want to work on With you and your staff to do, and again the goal will just be to avoid some needless litigation down the road when people are arguing about whether in fact what they submitted was a permanent application because my understanding is those differ from county to county. Do we've any further discussion or debate? Senator Walter for what purpose do you rise? To peak to the bill.   Senator Walter has floor to speak to bill   My concern about Section 7 of the bill and particularly the provision that asks that any removal of lanes within a municipality be reviewed by the full board of transportation. And often times these raw diets when we remove lanes are very important to municipality, to traffic count, traffic flow, pedestrian safety, bicycle safety. Particularly when you look at those parts of state roads, about churches, schools, hospitals, when they run through residential neighborhoods, they run through business districts, events spaces like ball parks and theaters where they are heavy used by pedestrians, by bicyclists. So these are often imported and not just in large municipalities but in small towns as well. I believe the provision here in Section 7 is duplicative unnecessary relatively prove to be closely to local governments. It will flow down projects forcing a review of all of these removals of lanes, these road giudes will require significant lead time. I talked with my two division engineers today and their projects could see as much as 90 day delay just for an initial review by the full Board of Transportation. It's going to require significant extra work on the part of the local governments, as well as, our division offices. Currently any request from a municipality to reduce the sides of a state road in its jurisdiction those though an incredibly tharal process first to request of the local government it is reviewed thoroughly by the division engineering staff and then the division engineering staff rules. These are not rubber stamps. Many of these are turned down. I reviewed with my two division engineers that they had a number of projects that they've turned down in recent years. So that work is already in place. You have that thorough review. Why did the Department of Transportation fire it's professional engineering staff? this will add yet another layer of review request all the way to the board of transportation. Thirdly it places the entire board of transportation in an unnecessary position. Will the division board member from division 14 understand the need division nine and be able to make a decision, a wise decision about a raw diet in division nine. Will the board member from division two to be able to fully assess a request from division five? I think not. You already have your engineering staff review this and make it's recommendation positively or negatively on the project. One of the things I think we've all agreed on and we've seen this change over the last decade in both Democratic and Republican administrations under the leadership of the Republic majority here in the General Assembly that we wanted the Board of Transportation to move away from this one off political decisions, and begin to set more policy and that's been a positive move. This I believe backs us up a step, and gets us into political one off kind of decisions that I think many of us thought were problem for sometime. The decision on these roads, ladies and gentleman, should be local, let the local decisions be local. Senator Wade for what purpose do you rise? To see if the speaker will yield to question. Senator Waddell do you yield for the question? Yes sir I do. Senator Waddell do you realize this is only talking about pipelines, when they're. I do, yes I do, absolutely do. Senator Waddell you have the floor. Yes sir thank you Mr. President, to continue, let these local issues be local. Lots of local officials work with their division engineering staff, and their division board member not bring this to the 14 member Board of Transportation. It's unnecessary it's duplicative and costly with that Mr. President I'd like to offer the amendment. You can sent forward your amendment senator. Clerk read.

[xx] be the case for why I believe this provision in section seven is unnecessary, duplicative, and will prove costly to the local governments. This would remove that section of the bill and make these local decisions local, and I urge your support. Senator Wade for what purpose of your rise? I would ask that you vote against the amendment these are roads that have been put in by the state money by tax payers and I think they should be reviewed by the board of transportation before we make those changes. do you have any further discussion or debate. Senator Wade, on this particular provision does the NCDOT have a stand on this that you know of?  Not that I know of Mr president I'd like to address the same question to the amendment sponsor. Senator wade do you yield for a question yes sir I will. Do you know if NCDOT has a stand on this particular provision? Senator Davis I spoke with my two division engineers I don't believe they speak for the department so I can't speak for the administration I know my two division engineers expressed their opposition to this for the reason that I stated thank you Mr president. Senator Stein for what purpose do you rise? To see if the bill sponsor will yield to a question. Senator Wade do you yield? Sure I will   Does the bill also require the Board of Transportation to approve any municipalities elimination of a by-claim and adding more car lanes? Senator Stan, there's the reduction of travel lanes to accomodate the addition of bike lanes within the existing paved and marked lanes of the State, any State highway system. So they haven't been made by plane yet Mr president follow up question do you yield for a follow up Senator Wade? Yes I do For there are plenty of bike lanes that exist in cities, and my question is if a city wants to eliminate a bike and add more car lanes does the board of transportation have to prove that?, and if not why are we burdening the Board of Transportation with these small decisions for bike lane addition, but not bike lane eliminations? I think this, mister president, this problem came fourth because there was already with beveling and they wanted to reduce the number of lanes to possibly two lanes or three lanes to put in a bike lane, the bike lane did not already exist. Do we have any further discussion or debate on the amendment. Senator Block for what purpose do you rise? Think I can ask for Senator Stance question. Senator Locky speaking on the amendment If you are looking at taking a by plain and to a car lane unless that by claim was made for senator Apodaca and senator [xx] when they ride bicycle you are going to allow more space in what is available in a regular black line so you will have to go through a regular road project and I want to see their model ten bicycle so Senator Smith Ingram for what purpose do you rise? To debate the amendment Senator Smith Ingram has the floor to speak on the amendment Well I understand that this roads were paved with taxpayer dollars I do understand what it means on being staid in this small town I urge you to support this amendment because we are promoting businesses this is we are promoting more activity in our small town and this will give the local government the ability to be able to track and recruit and provide economic development opportunities Senator Wade for what purpose do you rise? I will just reiterate the point that I've made, that why do we have a state board of transportation ruling on projects only all over the state. Again, we're taking that local authority, local control, local review it's already in place, our State Department of Transportation reviews by its engineering staff. Let's  our Board of Transportation be the policy makers that we want them to be and not sit here and rule on these by planes every time there's a request. Currently, and I'll use my county as an example, in Davie, use touch screen, like any type of tablet, iPad that you touch and you have your votes that are recorded. Where they're printed is on a spool of paper down in the lower corner that it's really tough to see if the name that you printed is on that printed receipt, but you don't get the receipt you really don't get see it because it rotates very quickly, your vote is actually kept on a key flop in this there is a lot of security issues with it also a lot of questions that people wonder if their votes are actually being cast away they wanted to I know we find some problems in the past which both relation will be very quick to respond and both sides where people are meant to vote for one party or one person is required to vote of the some of those have been curbed, but what we'll do with the new technology new machine is that when you print your ballot that you want to vote you will actually get a hard copy about to submit to those [xx] some of the other counties have a kind of a scan can sheet which I think most counties use right now that way you can see your ballot and you did vote for the people that you intended to vote for and if it was a mistake you can turn that into the elections official and that wip be But it will be cast out and you can cast your vote again in the same process to make sure that you vote for cast in a good way, I think we talked about this we worked at it I think it's a better way it's also a more secure way to vote to make sure that actual ballots that are printed or once that people will actually receive their ballot and who they voted for before it was recorded electronically and that's of security measure or someone trying to hack into the system or some way to interfere with voting process and I have had too many objections to that because I think it creates to secure a way Senator Brian has an amendment and I'll answer any questions.
